how to order
Terms & Conditions and Privacy Policy


interpretation: in these conditions:-



“buyer” means the person or company who accepts a quotation of granite memorials direct for goods, or whose order for goods is accepted by granite memorials direct.



“seller” means the firm of memorials masons named in the order, granite memorials direct.



“goods” means the memorial described in the order and any works (including inscriptions) to be carried out to complete such memorials.



“order” means any quotation of granite memorials direct which is accepted by a buyer or any order placed by the buyer which is accepted by granite memorials direct.



“monument” means any stone or other material on which work has been carried out by granite memorials direct.






materials: natural quarried materials can vary in colour and texture. all goods are sold subject to these natural variations and therefore cannot be guaranteed identical to any sample produced. all sizes are approximate and imperial measurements may be converted to metric or vice versa.









the buyer should check the details of the order the wording therein of the inscription, carefully. particular care should be taken in the spelling of names and the accuracy of dates. any alteration should be notified to granite memorials direct within seven days of the date of acceptance of the order and confirmed in writing by both parties. granite memorials direct cannot otherwise accept responsibility for any errors in an inscription on goods which comply with the terms of an order.









granite memorials direct will endeavour to deliver the goods or service within the time specified in the order; but if completion of any works are delayed through strikes, lock-outs, accidents, non-delivery of materials to granite memorials direct or other force majeure, a reasonable extension of time will be allowed. time shall not be of the essence of the contract unless expressly agreed in writing by granite memorials direct.









the title in the goods remains vested in granite memorials direct and shall not pass to the buyer until granite memorials direct has received, in cash or cleared funds, payment in full of the price for the goods.









a deposit as specified in the order or, if none is so specified, 25% of the price for the goods shall be paid by the buyer to granite memorials direct upon acceptance of the order. until payment is made of that deposit granite memorials direct shall not be obliged to commence any work, and any date specified for completion of the order shall be extended by the period of any delay in payment of the deposit. on completion of any engraving, but before the delivery of the goods, granite memorials direct may so notify the buyer and/or submit the invoice for the goods. the buyer can then inspect the goods as soon as possible and any complaint regarding the goods must then be notified in writing to granite memorials direct within 7 days after the date of such notification or issue of the invoice by granite memorials direct. the balance of the price for the goods shall be due and payable within 7 days after the date of issue of the invoice notwithstanding that delivery of the goods may not have taken place to the intent that granite memorials direct shall be entitled to defer fixing the memorial in the agreed place until after payment in full of the price of the goods in cash or cleared funds. if the buyer fails to make any payment on the due date then, without prejudice to any other right or remedy available to granite memorials direct, granite memorials direct shall be entitled to charge interest (both before and after any judgement) on the amount unpaid at the rate of 5% from time to time until payment in full is made.









(I) if the goods shall prove to be faulty in workmanship or material not in accordance with this contract within ten years of the goods being fixed in the agreed place, the goods (or such part thereof as applicable) shall be made good or replaced by granite memorials direct without any expense to the buyer, provided always that the fault is not as a result of damage caused by, or as a result of any act by, any third party. granite memorials direct shall have no liability to the buyer for any consequential loss to the buyer arising out of the provision of the goods (except in respect of death or personal injury resulting from negligence) and the total liability of granite memorials direct for any other loss of the buyer so arising shall be exceed the price payable by the buyer for the goods. (ii) in the event of a dispute, the national association of memorial masons offers a free and independent conciliation and arbitration service.






fees and vat:



fees to cemetery and churchyard authorities are the responsibility of the buyer but may be paid by granite memorials direct and added to the invoice. notification of such charges is given by granite memorials direct to the buyer in good faith. should these charges be increased at any time prior to the date of the fixing of the goods, the difference shall be paid by the buyer to granite memorials direct within 7 days of request for payment. vat will be payable at the rate applicable at the date of invoice, or at the date of payment if this is prior to the invoice being raised, or at the date on which the goods are delivered, or made available, if this is 14 days or more prior to the invoice being raised. 









all prices are in pounds sterling, inclusive of vat and exclusive of delivery charges. the default price for all products is for black granite, images shown in other colours are for illustrative purposes only and may not be of the exact specification of the product description, including the number of flower holders or accessories. you may pay by any of the credit and debit cards shown on the paypal website. we are under no obligation to accept your order. prices, offers and products are subject to availability and may change at any time prior to acceptance of your order. some burial authority requirements may incur additional charges to you order, for example foundation or sub-base charges or specific text within the inscription. we will confirm these to you once we have cememtery and grave details and have submitted the details of the headstone or memorial to the burial authority.



accepting orders and security



when you send an enquiry we will treat it as an offer to buy. if we accept your order, we will confirm that in writing eith via email or post, at which point we make a legal contract with you. however, we will be entitled to refuse to accept your order if we feel it necessary, in which case we will e-mail you as soon as we can to let you know. in deciding whether to accept your order we may use the information you have given to us, or we already hold about you.






cancellations and returns



you may normally cancel your purchase if you notify us within 14 days of delivery. if there is a fault or some other defect with your product you may return it to us within 28 days for a replacement or refund. this does not apply to faults caused by accident, neglect or misuse. we will send you returns instructions. your product must be complete, unused 'as new' condition (e.g., if you have opened the box to examine the product you must have done so without damaging or marking the product in any way). it should be returned in with the original box, packing and accessories. we will refund the money paid (not including p&p) by means of a sterling cheque made out to the buyer. this does not apply to tailor-made or personalised items.



return of faulty goods within 28 days



if there is a fault with your product (or other defect with your order) you may return the product within 28 days of delivery for replacement or refund: we will replace the product or refund your money when: the product is otherwise in 'as-new' condition; the product is complete with the original box and the packaging; our promise to replace or refund products does not apply to faults caused by accident, neglect or misuse. where goods are refunded due to fault or other defect, we will refund delivery charges.









sales on this web site are governed by english law and you agree to submit any dispute to the non-exclusive jurisdiction of the english courts. all orders are subject to these terms and conditions, and no amendments will be accepted by us. these terms and conditions only cover websites owned and operated by granite memorials direct. any links within these sites to other web sites are not covered by this policy and we accept no responsibility or liability for the content of websites that are not under our control. these terms and conditions do not affect your legal rights.
